What is the best place for disputing parties and their lawyers to meet with the ADR facilitator to settle a dispute? A bench in the park? A lawyer’s high rise office in the city? On the steps of the county courthouse? Although choosing the site of the proposed meeting might not seem to be so important, my experience leads me to believe that physical surroundings can make a difference.
My cabin in the woods is situated on a wooded tract next to my home in Bastrop, Texas. It will comfortably seat the two disputing parties, their lawyers, and me, and it has an open deck area that blends well with the adjacent woods. In my opinion, it provides a perfect spot for parties to carry on unhurried and informal discussions in a comfortable and stress-free environment.
